1. About these Terms
PowerCUBE (also referred to as PowerCUBEgummies) operates this store and website, including all related information, content, features, tools, products and services (the “Services”). The Services are powered by Shopify. By accessing or using the Services, you agree to these Terms of Service (“Terms”).
If there is a conflict between these Terms and our Privacy Policy regarding the collection, processing, or disclosure of personal information, the Privacy Policy controls for those privacy matters.
2. Eligibility and Your Account
You must be at least the age of majority in your jurisdiction (or have verifiable parental consent) to purchase. The Services are not directed to children, and accounts may not be created by individuals below the age of majority. You are responsible for all activity under your account and for keeping your login credentials secure. Notify us promptly if you suspect unauthorised access or use.
3. Health and Product Use
Our products are dietary supplements intended for healthy adults. They are not intended to diagnose, treat, cure, or prevent any disease. Follow label directions and do not exceed the stated serving. Consult a qualified health professional before use, especially if you are under 18, pregnant or breastfeeding, have a medical condition, or take medication. Keep out of reach of children. Individual results vary.
4. Orders, Pricing, and Payment
Prices are shown in AUD unless stated otherwise and may change without notice. We may limit, refuse, or cancel orders (for example, suspected fraud or resale). Payment is processed by our payment providers via Shopify. You authorise us and our providers to charge your selected payment method for the total order amount, including taxes, shipping, and duties where applicable.
5. Shipping, Delivery, and Risk
Orders are fulfilled via our third-party logistics partner and other logistics partners. Available shipping options, fees, and indicative timelines appear at checkout and in our Shipping Policy. Title and risk pass to you when the carrier records delivery to your address. International customers are responsible for local duties and taxes unless stated otherwise.
6. Returns, Refunds, and Consumer Guarantees
Our Refund & Returns Policy sets out change-of-mind returns and how to lodge a claim for faulty, damaged, expired-on-arrival, or incorrect items. Your rights under the Australian Consumer Law apply in addition to our policy. Where permitted, our remedy may be repair, replacement, or refund.
7. Content, Reviews, and Acceptable Use
Where features permit, you may submit reviews or other content that is accurate and lawful and does not contain spam, misleading claims, infringement, hate speech, malware, or privacy violations. Do not interfere with operation of the Services, attempt to bypass security, scrape or harvest data, or use the Services for any unlawful purpose.
8. Intellectual Property and Open-Source Licences
All content on the Services, including trademarks, logos, text, graphics, photos, video, and software, is owned by PowerCUBE (also referred to as PowerCUBEgummies) or its licensors and is protected by applicable laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes. No other rights are granted.
Open-source and third-party components used in the Services remain subject to their respective licences. PowerCUBE (also referred to as PowerCUBEgummies) uses Remix Icon under the Apache License 2.0.
9. Third-Party Services and Shopify (including enhanced features)
We use third parties to provide aspects of the Services, including Shopify for hosting and commerce functions and our third-party logistics partner for fulfilment. Their terms and policies may apply when you use those features.
Shopify may collect and process personal information about your access to and use of the Services to provide, protect, and improve the Shopify platform. We may enable Shopify enhanced features that incorporate data from your interactions with our store along with other merchants and with Shopify. For those enhanced features, Shopify acts as the controller of that processing and is responsible for responding to your requests relating to such use of personal information. For our own processing of personal information, see our Privacy Policy. If anything in these Terms conflicts with the Privacy Policy regarding personal information, the Privacy Policy governs.

Where permitted and with your consent where required by law, we may send marketing and promotional communications by email, SMS, or other channels. You can opt out at any time using the provided tools or by contacting us. We may still send non-marketing messages about your account or orders.
11. Disclaimers
We aim to keep information accurate and current, but the Services may contain typographical errors, inaccuracies, or omissions (including in product descriptions, pricing, and availability). We may correct errors and update information at any time. To the maximum extent permitted by law, the Services are provided “as is” and “as available”.
12. Liability
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law. To the extent permitted by law, we exclude liability for indirect or consequential loss, loss of profit, loss of data, or loss of opportunity. Where we can limit a remedy, our liability is limited to re-supplying the Services or paying the cost of re-supply, or for goods, repair or replacement, or paying the cost of repair or replacement.

Our Privacy Policy describes how we collect, use, and disclose personal information and explains your rights and choices. By using the Services, you acknowledge you have read our Privacy Policy. In any conflict between these Terms and the Privacy Policy on privacy matters, the Privacy Policy controls.

We may suspend or terminate access to the Services where reasonably necessary, including for security risks, suspected fraud, breach of these Terms, or unlawful activity. You may cease using the Services at any time. Provisions that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Liability, and Jurisdiction.

We may update the Services and these Terms from time to time for operational, legal, or regulatory reasons. We will post revised Terms on this page and update the date above. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
16. Jurisdiction
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and courts hearing appeals from them.
